1. Acceptance of Terms

By accessing and using ElevenDown Technologies LLC's website and services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Description

ElevenDown provides professional penetration testing and security assessment services including:

  • Web Application Penetration Testing
  • API Security Testing
  • Network Penetration Testing
  • Secure Code Review
  • Threat Modeling
  • Cloud & Infrastructure Security Assessment

3. Service Engagement

3.1 Scope of Work

Each engagement begins with a scoping call where we define specific testing parameters, systems to be tested, and rules of engagement. All work is documented in a Statement of Work (SOW) signed by both parties.

3.2 Authorization

Client represents and warrants that they have proper authorization to engage ElevenDown for security testing of all systems and applications specified in the SOW.

4. Client Responsibilities

As a client, you agree to:

  • Provide accurate information about systems to be tested
  • Obtain all necessary approvals and authorizations
  • Designate a point of contact for the engagement
  • Provide timely access to systems and documentation
  • Respond to critical findings within agreed timeframes
  • Not hold ElevenDown liable for any system downtime during testing (unless caused by negligence)

5. Confidentiality & NDA

All information exchanged during our engagement is confidential and protected under a Non-Disclosure Agreement (NDA). We commit to:

  • Keeping all client data strictly confidential
  • Using secure, encrypted channels for data transmission
  • Storing all findings and reports in encrypted systems
  • Destroying client data upon request after engagement completion
  • Never disclosing client information without explicit written consent

6. Deliverables & Reporting

Upon completion of testing, clients receive:

  • Detailed vulnerability report with severity ratings
  • Executive summary for stakeholders
  • Remediation recommendations and priority matrix
  • Re-testing of critical findings (as per service tier)

7. Payment Terms

7.1 Pricing

Pricing is outlined in the SOW. Our standard pricing tiers are listed on our website, but custom quotes may apply based on scope complexity.

7.2 Payment Schedule

Payment terms are net 30 days unless otherwise specified. For projects exceeding $5,000, we may require a 50% deposit before commencement.

7.3 Satisfaction Guarantee

First-time clients receive a satisfaction guarantee. If you're not satisfied with our initial assessment, you may request modifications or a full refund within 14 days of report delivery.

8. Limitation of Liability

ElevenDown's liability is limited as follows:

  • Total liability shall not exceed the fees paid for the specific engagement
  • We are not liable for indirect, incidental, or consequential damages
  • We do not guarantee discovery of all vulnerabilities
  • Pentesting may cause temporary service disruption despite best efforts

9. Ethical Testing Standards

We adhere to industry-standard ethical hacking practices:

  • All testing is conducted within agreed scope
  • Critical vulnerabilities are reported immediately
  • We do not exfiltrate sensitive data without explicit permission
  • Testing is performed during agreed time windows
  • All team members are certified security professionals

10. Intellectual Property

Upon final payment, client owns all rights to the security assessment report. ElevenDown retains rights to methodologies, tools, and techniques used. We may reference the engagement as a case study (anonymized) unless client requests otherwise in writing.

11. Responsible Disclosure

If we discover vulnerabilities affecting third parties during testing, we will work with the client to determine appropriate responsible disclosure timelines.

12. Termination

Either party may terminate an engagement with written notice. In the event of termination:

  • Client pays for work completed to date
  • We provide interim findings report
  • All confidential data is securely destroyed
  • Testing activities cease immediately

13. Modifications to Terms

We reserve the right to modify these terms at any time. Active engagements are governed by the terms in effect at the time of SOW signing.

14. Governing Law

These terms are governed by the laws of the State of Texas, United States. Any disputes shall be resolved through binding arbitration in Austin, TX.
